In a groundbreaking review of a provision of Qanun-e-Shahadat law, which exonerates a rapist by showing the victim to be of loose moral character, the Federal Shariat Court, on Wednesday (February 11, 2009), held the provision as against the teachings of the Holy Koran and Sunnah. A full bench of the Federal Shariat Court agreed
that Article 151(4), of the Qanun-e-Shahadat Order 1984, ran counter to Koranic teachings and that of Sunnah and must be repealed within six months by the president of Pakistan. If not repealed in that time, the provision will automatically become ineffective.
The bench’s decision about the said provision will put an end to over two decades of sexist discrimination against women while also getting rid of the article that allows a backdoor for rapists, and attempting rapists, to get away with their crime by making allegations of immorality against their victims. Thus the end of the provision will greatly facilitate in providing justice to victims of sexual assaults. The bench also expressed its wonder over the daylights of the lawmakers who had allowed such a law to be enforced in the name of Islam.
I think we need opinion polls,on a regular basis,on the laws and policies of our country. Democracy shouldn’t cease beyond the ballet box. Isn’t it?
karim you sound too democratic and beyond hope for Pakistan. this is true that you have a good opinion to make law after an open poll and this is the best democratic way a country can ever opt for. But for that you need a sound democratic base. Now if so and my memory serves me well democracy was always miles away from Pakistan as almost half of its decades after independence are ruled by the despotic army generals. what say???????
women rights???? are you crazy man!!!women have no life in Islam let aside the rights!!! I wonder if they know the meaning of human rights. this is a distant dream for the women in Islamic countries and god knows when they will be treated on equal footing...when????/
Sadly, the rape laws in most countries, including western, are draconian. Most women are very wary of even reporting a rape because the courts put them through hell. Then again you have idiots like the woman at Duke University who put the LaCrosse players through the ringer. It was finally proved that she was not raped. Meantime, the boys lives were all but ruined.
